Governmental Liability

It is difficult, but not impossible to sue the government. Claims against local, state and federal government agencies and their employees are difficult to pursue due to special immunities, time limits, and other procedural rules and deadlines. However, when someone is injured by the negligence of a government agency or employee, that person has a right to bring a cause of action to recover compensation for those injuries. Some typical government liability claims are based on:

  • Accidents involving government vehicles
  • Police misconduct, brutality, or unfair treatment
  • Civil rights abuse
  • Assaults or injuries at public schools
  • Negligent design or maintenance of roads, signs, or government buildings
  • Dangerous conditions on public property

The government (like anyone) simply does not like to be sued, and it has passed laws such as the Federal Tort Claims Act, the Mississippi Tort Claims Act, and 42 U.S.C. § 1983, each of which contain significant procedural obstacles to overcome in the pursuit of a claim.

Establishing government liability requires sophisticated legal representation, and experience in this area of law. It is important to consult with a knowledgeable attorney who can help you file the proper paperwork, protect your legal rights, and help you get the compensation you deserve for your damages. As a Marine judge advocate, Clarence defended the government against these types of cases, and now uses that experience to maximum effect representing individuals in Mississippi in claims against school districts, municipalities, the state, or the federal government.
