WHAT IF A DEFECT IN MY MOTORCYCLE CAUSED MY WRECK?
A manufacturing defect in a motorcycle can obviously magnify safety risks to you as a rider. If you are injured in a motorcycle wreck and come to us for guidance, when we investigate the causes we will look not only at who may have hit you and caused the wreck, but we will also investigate inside your bike for defects in the manufacturing process, or product recalls that could have been a factor.
If a manufacturer suspects a defect in one of its products, it can voluntarily issue a product recall, or the National Highway Traffic Safety Administration can order a recal based on certain criteria. When a recall is issued, the manufacturer must file a pubic report describing the problem, the bikes involved, how it is going to fix it, and the recall schedule. The remedy offered must be free by federal law. If you want to check to see if any recalls have been issued on your bike (or any vehicle or component), go here.
To prove a manufacturing defect claim against a manufacturer, we will have to show that:
- The motorcycle was defective
- The defect existed when you purchased it
- Your accident and damages were a direct result of the defect
These cases are difficult, as it may not be obvious that the problem was caused by the defect. The defense may also try to show that you were not riding the motorcycle properly.
We are prepared to help you with any type of motorcycle defect or products liability case. We will investigate the accident, retain the experts, and try your case if necessary to get you the results you deserve. Contact us today at at (601) 991-1099 or toll free at 866-991-1555.
